Each member of the Krewe of Themis agrees to become bound by the terms of this agreement (the “Agreement”) and I understand fully and completely all the terms and provisions thereof.
- Code of Conduct: Member agrees to abide by the Krewe of Themis Code of Conduct. The Board reserves the right to terminate membership or remove a Member from a float or the organization, without refund, for conduct deemed detrimental to the Krewe, its reputation, or public safety.
- Membership Compliance and Communication: Member is responsible for maintaining complete and current membership information on the member portal and consents to receive communications via email and text message from info@thekreweofthemis.org.
- Dues, Fees and Refund Policy
- Payment Requirement: To participate in the parade, all membership and float fees must be paid in full by the established dues deadline.
- Non-Refundable Status: Producing a Mardi Gras parade is a year-long financial endeavor. The organization incurs expenses for float construction, artistry, costumes, and municipal permits throughout the year. Annual dues are required by September 1st each year. Annual dues are non-refundable after September 15th. A $60 late fee applies to dues paid after September 1st. Dues not paid by October 1st are subject to member termination.
- New Rider Fee: A non-refundable registration fee applies to new members in their first year.
- Cancellations and Force Majeure: Refunds will not be issued in the event the parade is postponed or cancelled due to inclement weather, pandemic, or Force Majeure. If the City Charter prevents rescheduling, the Krewe shall retain all fees to cover organizational obligations and administrative costs.
- Retention of Fees: The Krewe of Themis is entitled to retain all collected fees, including those for services performed such as order fulfillment, delivery of memberships/products, shipping, and e-commerce service charges.
- Substitutions: Substitution of membership or participation in Krewe activities is prohibited without prior written approval from the Board with a completed substitution form.
- Throw Requirements and Restrictions:
- Supplemental Throws: The purchase of supplemental, non-branded throws from outside vendors is permitted, provided all items comply with Krewe standards and City of New Orleans safety ordinances.
- Prohibited Items: The throwing of traditional plastic beads is strictly prohibited. Members may not distribute items that are political, religious, or disrespectful in nature.
- Advertising: The use of throws for third-party business advertising or commercial solicitation is strictly prohibited and may result in immediate removal from the parade.
- Intellectual Property, Image, and Likeness
- Trademarks: Unauthorized use of the “Krewe of Themis” name or trademarked logo on third-party merchandise is prohibited without prior written approval from the Board.
- Media Release: Member grants the Krewe of Themis, its affiliates, and assignees a perpetual, irrevocable, worldwide license to use the Member’s image, likeness, voice, and “signature throws” in any media for promotional or commercial purposes without further compensation.
- Regulatory Compliance: Member agrees to comply with all laws and regulations of the City of New Orleans, New Orleans Police Department, Port Authority Police, the Krewe of Themis, and The Krewe of Freret.
- Release of Liability: Member hereby releases the Krewe of Themis, its representatives, officers, float lieutenants, and volunteers from any liability for injury or harm that may occur during participation in Krewe and parade-related activities. Member expressly assume all associated risks, including those related to outdoor events and inclement weather. Furthermore, Member agrees to indemnify and hold harmless the Krewe of Themis from any claims, actions, or damages—including attorney’s fees—arising from the Member’s negligent or intentional acts.
- Agreement Modification: The Krewe of Themis reserves the right to modify the terms of this Agreement at any time.
AGREEMENT ACKNOWLEDGEMENT
The Member agrees to be bound by all terms and provisions of this Agreement. The Member has read, understands and agrees fully to the terms herein.
